Limitation of Liability

1. Social Enterprise and Not-For-Profit Status

Aarunya Telangana is operated by SOH Foundation, a registered Not-For-Profit Organisation established for social development and artisan empowerment. All revenues generated through the Website are used solely for:

• Supporting artisan and rural livelihood initiatives
• Operational sustainability of the platform
• Social development objectives

No profits are distributed to trustees, members, directors, or any private individual. Users acknowledge that SOH Foundation functions as a social enterprise platform and not as a commercial profit-maximizing entity.

2. Protection of Charitable Funds

In recognition of its not-for-profit status, users expressly agree that:

The assets and funds of SOH Foundation are held and utilized for charitable and social purposes. Accordingly:

• SOH Foundation shall not be exposed to unlimited financial liability.
• Claims for speculative, indirect, or disproportionate damages shall not be maintainable against the Foundation.
• No claim shall be made that would jeopardize the charitable corpus or funds meant for social impact activities.

3. Exclusion of Indirect and Consequential Damages

To the fullest extent permitted under applicable law, SOH Foundation shall not be liable for:

• Loss of profits
• Loss of revenue
• Loss of business opportunity
• Loss of anticipated savings
• Loss of goodwill
• Indirect, incidental, special, punitive, or consequential damages

Whether arising in contract, tort, negligence, strict liability, or otherwise. This applies even if SOH Foundation has been advised of the possibility of such damages.

4. Limitation of Financial Liability

In all circumstances, the total liability of SOH Foundation, whether in contract, tort, negligence, or otherwise, shall not exceed:

• The total amount paid by the customer for the specific order giving rise to the claim.

Under no circumstances shall SOH Foundation be liable beyond the actual transaction value.

5. Marketplace Facilitation Disclaimer

Where products are supplied by third-party artisans, SHGs, or cooperatives:

• SOH Foundation acts as a facilitator.
• The sale contract exists between the customer and the artisan/seller.
• SOH Foundation does not guarantee artisan performance beyond reasonable oversight.

6. Force Majeure

SOH Foundation shall not be liable for failure or delay caused by:

• Natural disasters
• Government restrictions
• Pandemic-related disruptions
• Artisan production delays
• Courier service failures
• Any event beyond reasonable control

7. Consumer Rights Preserved

Nothing in this clause shall:

• Limit statutory rights available under Indian consumer protection laws
• Exclude liability where such exclusion is prohibited by law

This clause shall be interpreted to the maximum extent permitted under Indian law.
